I'm just trying to reach out there, and find out how the above Patriot user made out with his little incident with the off-duty cop.
Remember the incident?..She pulll out in front of him, and he had to swerve to miss her, he jumped the curb and now has damage and a pissing match with her on his hands.
Hey Kausen..any update?

Hey KFC, thanks for the concern!

The mechanic pointed out everything that was wrong....damages would be in-and-around $1700 - $2000!!!

So the lady told me that she doesn't have the money to pay for all the repairs and that she would go 50/50 with me. I told her that I am not paying for anything as it wasn't my fault. I then told her that I avoided hitting her and that I saved her from being seriously injured and that if she didn't want to pay that I am just going to go through insurance! She was strongly against that....she said that it would be the worst thing that I could do as it would hurt me financially..blah blah blah. Then I started thinking...why is she so adamant about not going through insurance? Anyhow I told her that I want to think about it during christmas/boxing day and that I would get back to her later on in the week.

As soon as she left the dealership I called my insurance and made a full report and claim. My insurace rep told me that I WOULD BE 100% AT FAULT as it would be classified as a single vehicle accident. I told her that I wasn't going to accept that as I prevented a major accident. She said that it will be hard to prove and that it would be easier to prove it I just hit her. She then said that she is going to launch a full investigation into it. She then asked me if the other lady reported it to her insurance, I told her that they other lady just wanted to do a cash deal and that she didn't want me to report it. So my insurace rep told me legally the lady has to report it as damage as it was more then $1000.00

Here is the golden rule....if MY insurance reports it to the lady's insurance before the lady does, then it will look like the lady is trying to hide it from her insurance (which was what she was trying to do). That will then put doubt on the other lady. My rep told me to leave it in her hand and she will work on it for me.

I got a last week from the insurance adjuster, and he said that he spoke to the cops insurance and they have found her 100% at fault for the accident! That means I pay nothing! My rates don't increase, I don't pay a deductible and I still maintain my accident free status!!! WOOHOO!!!

The lessons I learned:
Cops aren't above the law! Don't be affaid to take them on (legally).
The facts and the truth prevailed!

Ok so finally after 13days I got my Pat back from the dealership. She feels as good as new!

The repairs were:
1. Replaced Right Front Lower Control Arm Assy
2. Replaced Right Bearing
3. Replaced Right Inner Suspension Bolt
4. Replaced Right Outer Suspension Bolt
5. Replaced Right Sub Frame Bolt
6. Performed Alignment

Interesting. I understand this completely.
One time a guy smacked into the Wrangler of a girl I was dating. He pulled basically the same thing, and didn't call his insurance. So finally I said F'it and called HIS insurance and told them 'A client of yours totalled my girlfriends jeep, was cited and now does not want to involve you.'
Ohhh man... did they JUMP. Sooooo polite to me, handled everything lickity split and got the ball rolling for us without him.

I guess when Ins Co. hear of this they move quick because A-They can raise his rates and B-(possibly)Situations like that with someone being a hard a$$ can turn nasty and the Ins Co can end up getting sued and drug thru court.

Really glad it all worked out for you. What a Holiday story!

Jim

Kaushen, glad to hear your pretty SBO is back on its tires again! ;)

Good guys can win from time to time....

kaushen: so glad to hear it all worked out.

Toronto cop? York cop? Peel cop?
It was a female toronto cop that caused the accident.
The Halton Region Police came to the scene and made the report (since it happened in Milton) In the report he actually stated that she was at fault and that she originally agreed to pay for the damages.
He didn't charge with anything, the reason that she claimed to not see me was because a "extremely large snow bank blocked her vision".
Ah well...its over and I got my Pat back!

lol, wouldnt she lose her position as a street cop and be a desk cop lol(however it is in the movies lol) because she now has a accident on her name and government doesnt trust her with government vehicles
