You know what kills me?...Is this 'lady' as you keep referring her to, is an off duty cop. Thats why I'm so angry and ultimatley would want to start to get the ball rolling and get get both of those cops reported through the nearest cop shop.
Once again, it was the investigating cops direction that you persue it in this manner, the cop went on record and said it was her fault, she said send her an invoice, and now she's making up the rules as she goes along.
Get moving!!!!!!!!
 
In the United States you can always take her in to small claims court for the rental. Not sure about Canadian laws. She has no right and you have no obligation to go to her suggested repair places or for you to do without a car. She knows better as an off duty cop.

She "caused" the damage by her actions and is thus responsible.

Use your insurance! At that speed, you could have very well bent your frame or a number of other things. I had a friend that hit a curb at high speed and he ended up bendning the frame on his car.
 
myself,i woulg go through the insurance, i was once involved in a very similiar accident like you and the other driver volunteered to pay for the repair but attempted to dictate me the conditions [where to fix it etc] so i send her to hell and went through insurance,yes the insurance hiked up my rate the next year and so i dumped the insurance and went with the CAA insurance and I pay so much less these days,I think CAA is one of the top insurers in CAnada and I can recommand CAA to anybody,you'll be surprised how much you may safe over your existing insurance company

Unsure if this ever came out in this thread, but in the Province of Ontario, they have a 'no-fault' insurance system.
KFC, thanks for that info, I didn't even think about the different systems from one area to another.
Basically, that stinks for him. If I read everything right up to this point, he would have been better off to slam into the lady...talk about a double standard.:icon_rolleyes:
I suppose the only way (and probably really expensive way) to avoid an increase in rates is to pay out-of-pocket for damages? DAMN, what an option..
 
Go through insurance formalities, damages may be more than you expect!

I lost control once and my passenger back wheel hit side of sidewalk. Had dammage to wheel but also had to change everything from there to differential (shaft, drum etc.) The impact bent everything. Not only had the rim to be re-balanced !!!!

Off Duty is often used in terms for jobs like Police, Firemen, EMS. Since these people perform a public service as their job, their duties in and around the public change when they are 'on duty' from when they are 'off duty'.

Putting the designation before the title lets the reader or listener know where the person stands contractually.

Im calling her the off duty cop so people know Im not talking about the investigating officer.
its much better than continuing to call her 'they lady'
 
Time to go to the police, do the report and get the insurance company involved. That is why you pay insurance so you do not have to deal with the other party anyway.

If they increase your rates time to find another insurance company. Too bad you do not live in BC where they insurance is all public run, way easier to deal with.

Did she get charged/get a ticket for what she did? That will really play in your favour if she did.




So the lady called me and told me that she isn't going to pay for the rental. She said that it was my choice to take it to my dealership and that I should have just taken it to Canadian Tire (almost like a walmart with a repair shop.) Now, I don't want to take my 2008 Jeep to Canadian Tire....I'd rather take it to Jeep since they know how to deal with my ride. So i told her all that and she said that the only thing that she is paying for is the alignment. She then goes on to say that she really doesn't have to pay for anything because she didn't hit me, and that the damage to my jeep was caused by me avoiding her. She then said, before you get it fixed I want a second quote from my mechanic. My dealership told me that my Jeep isn't drivable....so am I supposed to tow it to her mechanic? And what if I don't want her mechanic to fix my jeep?

I took your advice and called me Insurance. They said that they will make a note of it and if I decide to pursue things then they will make it a claim, but for now I am just keeping them in the loop.

Oh...and if forgot to mention the best part....the Lady that caused all of this was of Off-duty police officer! So I think that I am going to have a battle on my hands.

As much as I hate to say it but Your screwed. The Off-Duty police officer is not liable to pay anything as she never hit your vehicle. It would be a different story if she was charged for careless but she wasn't so that makes it that much more difficult.

Now dependant on what your situation is, if its your first claim on your insurance I would put it through and your will only go up a little and I doubt it will go up any. If you have more than one claim on your insurance I reccommend just paying for it out of your pocket and rack it up as a learning experience.

Trying to fight this will more than likely cost you more than the repair and your chances of winning this one are pretty slim especially when your dealing with police services. I know they swear up and down that they are treated like any one else, but after seeing a few things that have gone on in my city with police officers, I know they get a little preferential treatment.

It sad to say this but, you would have probably been better off to let her hit you. Then the lines of fault and responsibility would be much clearer.

Another thought here also is that as a police officer, if she is a patrol officer, having been involved in an accident, regardless if she was at fault, could jeopardized her ability to do her job. Wonder if the investigating officer knew the off-duty officer personally, and if that was a determining factor in why no charges/citation was filed against her.

Understand this..... As an officer of the law, they deal with these sort of accident situations every day. They know how the system works, and what they can, and can't get away with.

My suggestion is to get yourself a lawyer, or speak to your insurance agent to see if their's will represent you....

In either case.... I hope to hear you posting that your SBO is back to its beautiful self once again very soon.

So a few hours ago I was driving home from doing shopping.
I was on a main street going north. I saw a car on a side street approaching the intersection. She didn't stop....then out of nowhere she came out of the side street straight at me. I jammed on my breaks...
First, if you had applied your BRAKES and not your 'breaks', you might have avoided the accident. i've never heard of 'ABS Breaks'....unless they're BROKEN.

Second, i would make your insurance agent aware of the accident but say that you are NOT filing a claim at this time. just in case she weasels out of the verbal deal, you can still pass it on to your agent. i can't believe the cop was telling you NOT to file an insurance claim. is he related to the person that caused it? oh, and remember, a 'verbal agreement' is only worth the paper it's printed on!

and Third, if you had used more "kaushen" while driving, we wouldn't be having this e-discussion right now....;)

Thanks to everyone for their advice. The dealership will be in touch with me soon to let me know the extent of the damage. I will post what the outcome is.

As for Jeepster...wtf is up with you anyways?

Caution is what I have been using!!! If I didn't avoid her I would have likely killed her and seriously injured my wife and myself. Avoidance was the key in allowing all of us to walk away with no physical injuries.

Hey guys,

So the dealership got back to me...there is $1,700.00 worth of damage to my Pat....might be $2,600.00 but they won't know for sure until they fix the first $1,700 worth of damage.

I will list all the things wrong once I get everything in writing. Everyone (including insurance) is telling me that it would have been better for me to hit the lady instead of swerving to avoid her....imagine the logic in that!

Anyhow, it's about 9:00pm Christmas Eve now, so I am going to leave some milk and cookies out for santa and hope that he fills my stocking with a cheque in the amount of $2,600.00 payable to Jeep/Chrysler.

obviously you don't know me, but i try to find some humor in every aspect of life, whether it's my surviving a colon cancer scare to the in-laws leaving our Christmas presents in KC. if you can't laugh at yourself, you'll have a very boring life.

regardless, Merry Christmas to all.....especially 'kaushen' and his family. for the record, i AM glad that they can give thanks at Christmas for being safe and sound after that accident.

Hey Jeepster..seems like your a real piece of work eh? Ya know the only idiotic thing I see over this whole thing, is your contribution to this thread.
And secondly, the only point I see pertaining to this issue is the one on top of your head. Your feeble attempt in damage control with your Merry Christmas greeting doesn't work for me.
You sure your not NearlyNormalJimmy in cognito? I just see too many traits in common.
